Beyond the Corrective Justice? Possibilities to Land Restitution after Solving the Armed Conflicts

Abstract

Restitution of lands, as a reparation instrument within the context
of transitional justice, has important tools for executing an action
articulated to the agricultural social justice objectives included
in the constitutional law and the international human rights law.
Challenges resulting from the implementation of the restitution,
in scenarios where armed conflict has been mainly caused by
social inequality, justify this articulation and reflect the need for it.
Explicitness and analytical identification of these meeting points
comprise the main intention of this article. The theoretical reference
turns around the possibility of having a corrective justice to achieve
social and redistributive justice.
