Special Issue: “Frontiers of Digital Law: AI Governance and the Protection of Neurorights”

Introduction

The rapid convergence between artificial intelligence and neurotechnologies is redefining the foundations of the global legal order. While AI governance seeks to establish frameworks of responsibility, transparency, and ethics for autonomous systems, the emergence of neurorights responds to the need to protect the last frontier of human freedom: mental privacy and integrity.

The Journal Opinión Jurídica invites academics, researchers, and legal scholars to submit original articles analyzing these challenges from a critical, comparative, and multidisciplinary perspective, with the aim of consolidating a strong doctrinal foundation for 21st-century law.

Strategic Thematic Areas

Area 1: AI Governance and Regulation

- Comparative regulatory frameworks (the EU AI Act vs. initiatives in Latin America).

- Civil and criminal liability for harm caused by algorithmic systems.

- Transparency, explainability, and bias in the use of AI by the state and the judiciary.

- Ethics by design and algorithm auditing in sensitive sectors.

Area 2: Neurorights and Protection of the Mind

- Constitutional recognition of neurorights: global trends.

- Mental privacy and the treatment of “neurodata” in the commercialization of BCIs (Brain-Computer Interfaces).

- Free will and self-determination in the face of neuromodulation and algorithmic manipulation.

- Forensic challenges: neuroscientific evidence in judicial proceedings.

Editorial Timeline (Accelerated for Scopus)

- Submission deadline: July 31, 2026.

- Peer review process: August - September 2026.

- Online First publication: as soon as the manuscript is approved (September/October).

- Full issue publication: November 2026.
