'False positives' and the treatment of extrajudicial killings in Colombia by the inter-American system of human rights

Abstract

The article addresses the treatment of the case of extrajudicial killings known as 'false positives' by the various national (the Constitution and penal law), regional (interAmerican system of human rights) and international (United Nations) institutions responsible for protecting human rights, but with a particular focus on the regional system. The article explores issues in relation to this kind of extrajudicial killings committed by state forces, addressing the question of legal responsibility of the perpetrators and the legal jurisdiction of the International Criminal Court for dealing with such cases.
