'Liquid constitutions'. A systemic-cybernetic essay

Abstract

In recent decades there has been an increase in the number of reforms to political constitutions throughout the world as well as in their integration into international treaties. This essay aims to explore, in light of systems theory and cybernetics, the reasons and purposes behind this phenomenon, or what have been denominated 'liquid constitutions'. The Constitution is the basic structure of any formal legal system and, consequently, when the society or certain elements within it demand important modifications to the legal system changes to the Constitution are required or their integration into existing international treaties in diverse ways. Given that our current historical, social and political context might be termed 'liquid modernity', following Zygmunt Bauman’s characterization, this implies that modern Constitutions are usually 'liquid constitutions'. Looking at these phenomena from the perspective of systems theory and cybernetics can help us to better understand their diverse aspects and functions.
