Abstract

The main point of this article to demonstrate, from the notions of environment and contract protection –especially reflated to positive Colombian Law, that the main exiting theories in contract law, in a way or the other, have made important contributions related to ecological implications of a contract, but that no one has
had this as its main object of study; therefore, it is necessary, in order to study the protection of the environment in mercantile contracts Colombia, to resort to a theory different from the contract law.
