Le juge constitutionnel colombien, législateur -cadre positif: un gouvernement des juges

Abstract
La place de justice constitutionnelle dans le monde est un thème d'actualité mondiale qui suscite réflexions et interrogations. La Cour Constitutionnelle de la Colombie, depuis sa création (la Charte de 1991) a aussi modifié des présupposés jusqu'alors intouchables, comme par exemple celui de la sécurité juridique. L'impact de la jurisprudence constitutionnelle, défendant les postulats de la protection de la Constitution, de l'Etat de Droit, et des droits fondamentaux, a été tel qu'on en est arrivé à utiliser l'expression connue de 'gouvernement des juges' pour décrire cette nouvelle situation juridique colombienne.
