Falacia de las cláusulas exorbitantes en la contratación estatal

Abstract
El concepto de cláusula exorbitante ha sido un criterio primordial para identificar los contratos administrativos o estatales, tanto en el derecho colombiano como en el derecho francés; pero es pertinente afirmar que, de acuerdo con la consagración que hace el estatuto contractual, la noción de cláusula exorbitante o excepcional no existe en nuestro ordenamiento, sino que, por el contrario, la Administración está dotada de prerrogativas que hace valer frente a los administrados, dentro del procedimiento administrativo de contratación. En las anteriores circunstancias es viable decir que el criterio comúnmente aceptado de cláusula exorbitante es una falacia en nuestro sistema jurídico.
