Abstract
El propósito del artículo es analizar el papel de la justicia y del juez en los temas económicos y de los negocios internacionales ante los TLC, temas que merecen un estudio profundo por la necesidad de contar con sistemas jurídicos que provean la estructura idónea para responder ante dichos campos. La credibilidad de la justicia referente a estos temas no deja de estar en entredicho. Sin embargo, existe la posibilidad de que la designación de jueces económicos y de negocios internacionales en general pueda mejorar las condiciones en que las empresas se enfrentan ante situaciones de carácter legal. Dicha opción podría generarse si se hace un análisis económico del derecho y de la estructura jurídica. Al respecto, es importante buscar mecanismos que permitan mejorar la acción eficaz de la justicia en los temas económicos y de los negocios internacionales dispuestos en los TLC.
